Todd Presnell, a partner based in Bradley’s Nashville and Atlanta offices, is a trial lawyer. He has tried 27 cases to verdict and otherwise served as lead trial counsel in several jurisdictions, including federal or state courts in Arizona, Colorado, Connecticut, Florida, Georgia, Illinois, Minnesota, Mississippi, New Mexico, New York, Tennessee, and Texas. He has argued before the Court of Appeals for the Sixth, Seventh, and Tenth circuits, the Tennessee Supreme Court, and the Tennessee Court of Appeals, and served as lead counsel on merits and amicus briefs before the United States Supreme Court, Federal Circuit Court of Appeals, Tennessee Supreme Court, Texas Supreme Court, and Tennessee Court of Appeals.

His litigation experience includes products liability cases in the automotive, powersports vehicles, equipment manufacturing, food product, and manufactured housing industries; professional negligence cases; employment discrimination cases for small, privately held companies, multinational corporations, and governmental entities; commercial litigation involving financial institutions; enforcing or challenging non-compete and non-solicitation agreements; litigation over trade secrets violations; litigation of contractual, regulatory, and business disputes involving healthcare companies; fiduciary duty disputes involving corporate directors and officers; trust-related litigation; and business tort claims, including fraud, misrepresentation, and RICO claims.

Todd serves as lead trial counsel in Alabama, Georgia, Mississippi, Missouri, South Carolina, and Tennessee defending a Fortune 500 manufacturer of powersports vehicles and related products in products liability and business-related lawsuits; as lead trial counsel for a subsidiary health insurer of a Fortune 100 insurer in lawsuits filed in various states, including Florida, Ohio, and Arizona; and formerly served as lead trial counsel for the western region, covering the states of Arizona, New Mexico, Colorado, and West Texas, in employment-related and other lawsuits filed against the then-largest marketer, producer, and bottler of Coca-Cola® products.

Todd was peer-nominated and elected to be a member of the American Board of Trial Advocates (ABOTA) and served as the 2022 president of ABOTA’s Tennessee Chapter. He has served on faculty at the International Association of Defense Counsel’s Trial Academy held at Stanford Law School and in ABOTA’s Masters in Trial program, two of the preeminent trial-instruction academies in the country. Todd is a former chair of the Tennessee Bar Association’s Litigation Section.

Todd is a member of the Board of Directors of the National Foundation for Judicial Excellence, a nonprofit organization dedicated to addressing legal and policy issues in the civil-justice system through judicial education. In addition to his work on the board, he is the chair of the 2024 NFJE Annual Symposium, the premier conference for intermediate appellate judges and supreme court justices from across the country.
